10 day rule asked 16 Mar 2010
Dear George Stein,
Where do you go to appeal for the 10 day rule after a DUI, and what exactly is the 10 day rule?
Thank you,
The 10 rule applies to those arrested for DUI in Georgia, who have either refused a blood, breath, or urine test, or have taken the breath test and scored a .08 (.02 for minors) or higher. The officer will (usually) issue the arrestee a “1205” form, which puts a citizen on notice that they are suspended. To appeal the suspension the DMV (modernly called “DDS”) you must request a hearing in writing within 10 days of the arrest. The address to send the request is on the back of the 1205 form.
