Atlanta race DWI asked 8 Sep 2010
Our plan was to stay with friends in the infield at the speedway but my wife got extremely druck and demanded to go home. She could not drive and l hadn't have a beer in several hours so I had to drive. Here is the problem, I plead guilty to a DUI in O8 and am still driving on a work permit even though I am now cleared to get my full DL back. I was stoped in a check point just out side the race track and was charged with driving on a revoked DL and DUI. I believe I was fine to drive and they were just hoping to get me on the blood sample. The field test was done, not sure if I passed or not. Breath test were done and they wouldnt tell me the results. I refused the blood test and they gave me a seach warrant for my bloood, so I had to let them take it. Of course it was several hours after the arrest and I have no idea want those finding were... Can you help me and should I plan on saling by harley to pay for your services.... :)Bud: It looks like this will be your 2nd Dui in a 5 year period. As a general rule, Georgia measures Dui’s by looking a five year window. On a 2nd in 5, the penalties go up dramatically. Mandatory jail time is anywhere from 3 days to 90 days, and the community service jumps up to 240 hours! If convicted, your license would be suspended for 3 years. In one respect, you are fortunate…Roadblocks are subject to stringent rules that must be followed inorder to be deemed legal. If the police made any mistakes during the roadblock/Checkpoint, then all of your charges should be dismissed.
