Following a car through a green light at a regular distance. Just before they entered the intersection the light turned yellow. SHE proceeded to slam on the brakes. With my larger car, slower reflexes and longer stopping distance, I hit her just inside the intersection. She had not even come to a stop when I hit her. I got the ticket for following too closely. I didn't do anything different than any other person going through a typical intersection. Was her eradicate decision to stop the real cause of the accident and more unsafe than continuing through the light? I think so.
Whenever one car rear-ends another, it is usually presumed that the 2nd car is at fault. When a car in front of you drives in an indecisive or erratic fashion, you still have a duty to keep at a safe distance. I understand your frustration, but this kind of ticket is hard to dispute. Your only real hope might be to ask the solicitor (prosecutor) to change the charge to a no points violation. This might be an option if you have a clean driving record. Otherwise, a “no contest” (nolo) plea to the charge would help since you would receive no points on your record. On a different note, there is a high expectation that the other driver will file a claim against your insurance company for damages to her car. Therefore, you must make certain that you notify your insurance company about the accident within a reasonable amount of time. Failure to do so might result in your company refusing to pay for the damages.
