Employee Per Diem  asked 7 Aug 2010
I have been traveling to North Carolina to do work for my company which is based in McDonough. Previously they were paying for the hotel rooms we were staying in, and then giving us $140 cash for food expense(Sunday evening to Friday Afternoon, I believe it was $28 per full day). Now my employer has rented an apartment, and now states that since we have the apartment they are no longer going to pay for our food expenses. Are they legally obligated to pay us per diem still?

If there is no contract indicating the per diem policy terms, there's no legal obligation for the employer to continue paying the per diem
