Is it true that the court must give you a fair and speedy trial within the 45 days of arraignment? I received a speeding ticket on 8-6-10. Had my arraignment on 9-7-10, and now have a trial date of 6-3. Can this be dismissed based on the fair and speedy trial defense?

You have a constitutional and statutory right(in Ga) to a speedy trial. However, the rules to invoke this right are somewhat complicated and require knowledge of the law. It doesn’t happen automatically with every case.
