Family Law - Custody  asked 17 May 2010

I've been paying child support since 1999 for two children. the younger child (13) wants to

live with me for the next school year. I would like to know what my obligations and expectations should be as far as child support. My other child is 16. I pay no alimony and my ex-wife makes comparable salary to mine (actually more with contract work). MY ex-wife pays insurance for both kids and I pay deductibles and whatever insurance doesn't cover. Thank you for any assistance you could provide.

If your younger child wants to live with you, it should be addressed with the court first as a custody issue. It would certainly help if your ex-wife “consents” to the new living arrangement for your 13 year old. However, it would be a good idea seek a modification of your custody and child support order issued by the court in 1999. I suggest you call attorney Bill Morse for a consultation on this matter.
