I received a ticket & summons for not moving over one lane to two police officers writing a ticket. This happend in Doraville & I was not speeding & was following a truck in front of me who also did not move over. I called about the fine & they said this is a mandatory court appearance. I have a clean record no offenses or tickets at all! What would you recomend I do? I feel this is really a bogus charge since while this officer was writing my ticket not one vehicle observed this move over law!! Please advise me on what options are. Thank you.
The new move over law was supposedly designed to keep police officers safe while tending to pulled over cars. The problem is that some jurisdictions tend to set up traps and use this law as a revenue raising scheme. I suggest that you talk to the prosecutor and tell him that the truck was blocking your view which gave you no time to pull over. They might also consider changing the charge to a city ordinance, which would not show up on your record. Remember that prosecutors are not swayed by the fact that other people were violating the same law and were not ticketed for it!
