NO Right on Red!  asked 5 Aug 2010
I was pulled over for turning right on red at the corner of Pharr Rd. and Piedmont in Buckhead. I got a ticket and asked the officer where a sign was posted, since I didn't see one. I have no history of traffic violations and want to continue to keep my record intact. After a trip back down the road I took pictures and found no posted sign visible by the signals and the only sign posted was on a telephone pole by a bus stop at 4ft to 5ft high. When stopped at the light, the sign is even with your roof and is only visible by a passenger. I have taken pictures from all angles, showing the sign being blocked by both bus riders and over hanging limbs on trees between the post office and BP as you approach the intersection. besides the pictures, what other information would be helpful in getting this ticket dropped and should I wait until my court date to resolve this or is there a faster way to resolve the matter. Chris; It would appear from your description that the sign is inadequately posted and thus didn’t put you on notice of the prohibited right turn. Your court will be the Municipal Court of Atlanta, so I suggest that you go to the listed date on your arraignment. Talk to the Solicitor when they call you up and show them the pics…Chances are they will dismiss your ticket or reduce it to a non-reporting violation that will not show up on your record. If not, plead not guilty and place your matter on a bench trial calendar. Call my office if you need further instructions at that time…Hope helps…
