ticket for a car wreck asked 28 Sep 2010
i was involved in an accident on 75 south right on that crest turn at the grady curve.it was two cars where the back one hit the firt. and i was a car behind he was weaving traffic in the first place changed lanes real quick to the left and i was trying to avoid that wreck and turned forward to see the bender he was dodging. they were stopped in the lane and i wa unable to top at that point and hit the back vehicle. the GSP officer gave the middle car a ticket for following too closely and gave me a ticket for the same. my point is the first driver said that she was hit before i hit the middle car and explained that to the officer. the middle car said she was pushed by me into the first car. i am wanting to know if i can challenge the following too close ticket in court and i am wanting to get the middle driver for lying and a false testimony.Usually following a rear-end collision an officer will attempt to make a determination as to the cause of the accident and hold a party at-fault. This Is done more for insurance reasons. It is very uncommon for an officer to cite two individuals for following too closely in one accident, but it is not unheard of. My reading of what occurred is the officer had two different stories as to who struck who first, so he took the easy way out and cited you both so the first car in the three car accident could state they were not at fault. What this allows is instead of the officer making a fault determination, he basically left it up to a court. So to answer your question, you absolutely can fight the ticket, and probably should, as otherwise, you may be held liable for the damage to all three vehicles. I Would tell you to report the accident to your insurance company as well as the middle car, and tell both that you were not at fault. Then go to the Court date, and run this by the prosecutor and even a judge if necessary, as usually they will not hold two people at fault for the same accident. If you just pay the ticket, it will go in as a guilty plea.
