I was turning left, I saw the other car coming but it was far enough away to slow and allow
me to cross. As I turned the other car didn't slow nor try evasive actions and it hit me in the last 12 inches of my car. The driver of the other car didn't have insurance and his tag was not from the car he was driving, it was not his tag. The state trooper put me at fault. Can I fight this. Another police said to me the other car should have slowed, the other police said he would have put the other driver at fault.
Just because you were cited as being at fault, doesn’t mean you can’t contest liability. The first step would be for you to fight your traffic charge. If you can successfully beat the (improper left turn/failure to yield??) ticket in traffic court, it would open the door for you to “revisit” who was actually at fault for a civil liability. Keep in mind the two hurdles that you must climb. First, it is generally presumed that if other cars have to slow down while you are turning left, that you are at fault. Second, even if you can get your traffic ticket dismissed, you will not likely gain much by suing a guy who has no insurance and a fake plate on his car! Your best bet might be to win your traffic charge, and then file a claim against your own insurance policy under your uninsured motorist (“UM”) coverage. In Georgia, an insurance company cannot (in most cases) cancel you nor hike your rates for filing a UM claim….I hope you get good results!.... George Stein
